When you access TradeXBank AG’s ("TXB" or  "We") website you declare your agreement with the following provisions. Please note that the accuracy, completeness, and confidentiality of data provided on the internet in general cannot be guaranteed. TXB is committed to safeguarding the personal information that we collect from individuals who use the TXB website. Accordingly, TXB has developed this statement to describe how and what type of data will be collected from users of the TXB website and the purposes for which TXB may collect, share or disclose the data. TXB also outlines reasonable precautions which are taken to keep your data secure.This statement applies to any information obtained by TXB through your use of the TXB website. It is not applicable to any internet websites controlled by third parties not affiliated with TXB that the TXB website may link to ("Third Party Sites"). Please review the privacy statements of Third Party Sites as TXB is not responsible for and has no influence on the content or the privacy practices of Third Party Sites. The terms of this statement are subject to any additional terms of disclaimers or other contractual terms you have entered into with TXB such as client privacy statements or notices, and any applicable mandatory laws and regulations.

2. Information to be collected and purpose    
When you visit the TXB website, our web server automatically records details about your visit (for example, your IP address, the web site  from which you visit us, the type of browser software used, the TXB website pages that you actually visit including the date and the duration of your visit). In addition, we collect personal data which you provide through the TXB website, for example when you enter personal details (e.g. name, gender, 
address, e-mail address, phone/fax number) on a registration page or if you  sign up for an email newsletter. TXB will use your personal data:    
- for the purposes of technical administration and research & development of the TXB website
- for customer and user administration and marketing
- to inform you about our services and products
- for such purposes as otherwise specified

TXB respects applicable laws and regulations in its use of personal data.

3. How to collect and store information from you
TXB uses tracking technology such as cookies or tags to gather information as outlined above to understand how visitors use the TXB website. Tracking technology helps us manage and improve the usability of the TXB website, for example by detecting whether there has been any contact between your computer and us in the past and to identify he most popular sections of  the TXB website.    

Where available, the “Cookies” link at the bottom of the page  gives you more details about TXB’s use of cookies and lets you control which types of cookies the TXB website may set on your device (known as your “cookie  settings”).  Please ensure that you set your cookie settings by un-ticking certain types of cookies if you do not consent to their use by TXB. When you  save your cookie settings, they should also apply to your future visits to the TXB website. However, for technical reasons beyond TXB’s control, this cannot be guaranteed. For example, if you reset your browser, delete your cookies or access the TXB website from another browser or device your cookie settings may be lost.    

When you visit our website, general access data is stored in a log  file for statistical purposes. Such log information includes the following items:
- IP address
- Date and time of access
- Name of the file retrieved
- Access status (OK, partial content, document not found, etc.)
- Page from which access occurred
- Top level domain (*.ch, *.fr, *.com etc.)
- Web browser used
- Operating system used
- Platform used (desktop or mobile)

TXB processes such data in anonymized form, for example, to determine which days have an especially high number of visits. No personalized evaluation of the log files is made.    

3.1. Job applicants

As job applicant, it may be determined which personal data will be available to TXB for that purpose, typically first and last names, e-mail  address, address, telephone number, gender, occupation, and biographical data on career path and interests (including data contained in attachments which are uploaded. Please note that data on (i) religious, ideological, political or trade union opinions or activities, (ii) health (including genetic and biometric data), private life or racial or ethnic affiliation (iii) criminal prosecution or penalties and (iv) social assistance measures are considered sensitive personal data under the Swiss Federal Act of 19 June 1992 on Data Protection (FADP). Please do not submit such data.    

TXB processes personal data provided for recruiting purposes only. The upload of application documents, such as personal information (including all the data and application documents supplied to TXB) are subject for screening personal data for purposes of the recruiting process (i.e. analyze and review your personal information and compare it with current job vacancies.

Following the legal basis of data processing according to FADP Article 4, TXB stores personal data for a 6-month period. At the end of this period the personal data is anonymized or deleted and finally and irrevocably, except for such data as is required to retain by law or the processing of which is useful for handling the assertion, exercise or defense of legal rights. Anonymizing data instead of deleting personal data, guarantees that the data will no longer contain any personal references after being anonymized, which means that neither TXB nor third parties will be able to associate such data with the job applicant.    

3.2. Business contacts

When contacting TXB via e-mail, personal data is provided (e.g. name and e-mail address of employees who serve as contact persons). TXB processes the personal data received for the use of providing services. TXB uses personal data only if and insofar as necessary to provide requests with the services they have requested or may use.


The legal basis of data processing for the purpose of providing services is conform with Swiss FADP Article 4. All data generated before or during a business relationship will be stored for up to 15 years after the fulfilment, termination or expiry of a (attempted) business relationship.        

4. Disclosing of collected information from the TXB website

TXB may disclose your information to its affiliates and its and their agents and third party providers inside or outside your country of residence to perform services for TXB and for the purposes stated above. Our affiliates, agents and third party providers who have access to personal data obtained through the TXB website are obliged to respect privacy. When transferring personal data internationally we make sure that we comply with applicable laws and regulations, for example, by entering into agreements which will ensure that the recipients of your information maintain an adequate level of data  

protection. We may also disclose your information to governmental agencies or entities, regulatory authorities, or other persons in line with any applicable law, regulations, court order or official request, or under any and for the  purposes of any guidelines issued by regulatory or other authorities, or  similar processes as either required or permitted by applicable law.

    

5. Security measures

TXB has implemented reasonable technical and organisational security measures to protect your personal data collected by TXB via the TXB website against unauthorized access, misuse, loss or destruction.

    

6. Liability

TXB accepts no responsibility and rejects all liability

- for the security of your data during transmission over the  internet
- if a third party changes, inspects, accepts, uses or sells the data that you or TXB entered
- for malfunctions in the internet, imported data of any kind (infection by a virus, etc.), and in connection with links from and to other websites    

Your data will be used for informing you about TXB services and products only to the extent permitted by the relevant laws and regulations.

7. Google Analytics and Google Remarketing

This website uses Google Analytics and Google Remarketing. These are services provided by Google Inc. ("Google"). Google uses cookies, which are text files that are saved on your computer in order to analyze your  use of the website. The information generated by a cookie about the way you use the website (including your IP address) is transmitted to and saved on a Google server in the US. Google observes the data protection provisions of the U.S.-Swiss Safe Harbor Agreement and is registered as a certified Safe Harbor company with the United States Department of Commerce.


The following anonymized data can be saved and analyzed in  connection with the use of this website:    

- IP address
- Sites that are visited and their order (a tracking cookie may be installed)  
- Operating system and browser being used
- Date and time when the site was visited
- Address of the previous website if a direct link on it led you to the current site

Google uses this information to analyze how you use the website,  to compile reports about web activities for SBS, and to provide other services  in connection with internet use. Google may transfer this information to third  parties, provided that doing so is prescribed by law or if Google orders a  third party to processes the data. Third-party providers, including Google, can  activate ads on websites and use the cookies that are stored in order to  activate ads on the basis of the user's prior visits to the site. Under no  circumstances will Google associate your IP address with other data that it  has. Permission to collect and save data can be revoked at any time, but not  retroactively. Most internet browsers allow you to deactivate cookies (see the  instructions in your browser). We need to point out, however, that deactivating  cookies may restrict some of the functions of this and other websites.

By using this website  you agree to have Google process the data that has been collected about you in  the ways and means and for the purpose described above. Permission to collect  and save data can be revoked at any time, but not retroactively.

Processing of (personal) data by the operator of the recruitment website

General information

This recruitment website is operated by Personio SE & Co. KG, which offers a human resource and candidate management software solution (https://www.personio.com/legal-notice/). Data transmitted as part of your application will be transferred using TLS encryption and stored in a database. The sole controller of this data within the meaning of article 24 of the GDPR is the enterprise carrying out this online application process. Personio’s role is limited to operating the software and this recruitment website and, in this context, being a processor under article 28 of the GDPR. In this case, the processing by Personio is based on an agreement for the processing of orders between the controller and Personio. In addition, Personio SE & Co. KG processes further data, some of which may be personal data, to provide its services, in particular for operating this recruitment website. We will refer to this in more detail below.

Access logs (“server logs”)

Each access to this recruitment website automatically causes general protocol data, so-called server logs, to be collected. As a rule, this data is a pseudonym and thus does not allow for inferences about the identity of an individual. Without this data, it would, in some cases, be technically impossible to deliver or display the contents of the software. In addition, processing this data is absolutely necessary under security aspects, in particular for access, input, transfer, and storage control. Furthermore, this anonymous information can be used for statistical purposes and for optimizing services and technology. In addition, the log files can be checked and analyzed retrospectively when unlawful use of the software is suspected. The legal basis for this is §25 subsection 2 Sentence 2 TDDDG. Generally, data such as the domain name of the website, the web browser and web-browser version, the operating system, the IP address, as well as the timestamp of the access to the software is collected. The scope of this log process does not exceed the common log scope of any other site on the web. These access logs are stored for a period of up to 7 days. There is no right to object to this.

Error logs

So-called error logs are generated for the purpose of identifying and fixing bugs. This is absolutely necessary to ensure we can react as quickly as possible to possible problems with displaying and implementing content (legitimate interest). As a rule, this data is a pseudonym and thus does not allow for inferences about the identity of an individual. The legal basis for this is §25 subsection 2 Sentence 2 TDDDG. When an error message occurs, general data such as the domain name of the website, the web browser and web-browser version, the operating system, the IP address, as well as the timestamp upon occurrence of the respective error message and/or specification is collected. These error logs are stored for a period of up to 7 days. There is no right to object to this.

Use of cookies

So-called cookies are used on parts of this recruitment website. They are small text files which are stored on the device with which you access this recruitment website. If the personal data is processed with your consent, you have the right to withdraw this consent under article 7 III of the GDPR. Concluding provisions

Personio reserves the right to adjust this data privacy statement at any point in time to ensure that it is in line with the current legal requirements at all times, or in order to accommodate changes in the services offered, for example when new services are introduced. In this case, the new data privacy statement applies to any later visit of this recruitment website or any later job application.
